1. Purpose

These Terms of Use ("ToU") define the conditions for accessing and using the Maintova application (the "Application" or "Service"), published by Habib HENNI (business name "HB Concept"). They complement the Terms of Sale ("ToS") and the Privacy Policy.

2. Acceptance

Use of the Service implies full acceptance of these ToU. When creating an account, the user acknowledges having read and accepted them. Failing acceptance, the user must not use the Service.

3. Description of the Service

Maintova is a software solution (SaaS) for machine maintenance management: managing customers, equipment, interventions, preventive maintenance, inspections/checklists and report generation. The Service is reserved for professional use.

4. Access and accounts

The Service is intended for companies and their staff.
Access requires an account: a company registers and creates an administrator account, which can then create accounts for its technicians, within the limit of its licence seats.
The user undertakes to provide accurate information and to keep their credentials confidential. Any action performed via an account is deemed to be carried out by its holder.
The client company is responsible for managing the accounts it creates (activation, deactivation, permissions).

5. Email verification

Creating an account by self-registration may require email verification. Access to the Service may be restricted until this verification is completed.

6. User obligations

use the Service in accordance with its purpose and applicable regulations;
not undermine the security or integrity of the Service;
not attempt to access data belonging to other companies;
not upload unlawful, defamatory content or content infringing third-party rights;
ensure they have the right to process the personal data they enter (customers, contacts, technicians) and comply with their own GDPR obligations as controller of that data.

7. Intellectual property

The Application, its structure, code, interfaces and the "Maintova" trademark are the exclusive property of Habib HENNI ("HB Concept"). These ToU grant a simple right of use, personal, non-exclusive and non-transferable, for the duration of the subscription. The content entered by the user (customer data, reports, photos, etc.) remains the property of the client company.

8. Availability and maintenance

We endeavour to ensure the availability of the Service, without guaranteeing uninterrupted operation. The Service may be temporarily suspended for maintenance, updates or security reasons. Some features may change.

9. Offline mode

The Application may offer partial offline operation with later synchronisation. The user remains responsible for the proper synchronisation of their data once the connection is restored.

10. Liability

The Service is provided "as is". Within the limits permitted by law, the liability of Habib HENNI ("HB Concept") cannot be engaged for indirect damages, loss of data resulting from misuse, or the inaccuracy of content entered by the user. The liability limits applicable to the paid subscription are set out in the ToS.

11. Suspension and termination

In case of breach of these ToU, we may suspend or terminate access, where applicable without notice in case of serious breach (security breach, unlawful use). Subscription termination conditions are set out in the ToS.

12. Changes to the ToU

The ToU may be amended. The applicable version is the one published at https://maintova.web.app. In case of substantial change, users will be informed.

13. Governing law and disputes

These ToU are governed by French law. In case of dispute, and failing an amicable resolution, the competent courts shall be those of Belfort (France), subject to applicable mandatory rules.

14. Language

These documents are drawn up in French, which is the authoritative version. Any translation (in particular into English) is provided for information purposes; in case of discrepancy in interpretation, the French version prevails.
